LIABILITY RELEASE

Description of Promotion/Participation.

KYZX 103.9 The Eagle, Hanson Hot Spring, Crested Butte, Diamond City Jewelers, Skyway Creations & Rocky Mountain Chocolate Factory may be referred to as “The Sponsors” from this point forward.
Dates of Promotion: The Promotion will begin on 1/21/08 and ends on 2/09/08.
How to Enter: No Purchase Necessary

Listen to KYZX, 103.9 THE EAGLE. Radio station will select sixty (60) qualifiers on-air through a “Valentine’s Day Sounder”, to be played a minimum of four (4) times per day, Monday through Friday.
KYZX 103.9 The Eagle will conduct a random drawing from all eligible entry forms collected during a live broadcast on Thursday, January 24 2008, Friday, February 1 2008 & Friday, February 8 2008 selecting one (1) qualifier from each live broadcast.

No machine entries accepted. All entries are the property of KYZX 103.9 The Eagle, and will not be returned. All participating sponsors are not responsible for lost, late or misdirected entries. Limit one entry per person per day.

Final determination of winner: only one (1) winner

All qualifiers will receive a laminated number upon arrival on February 9^th, at a Hanson Hot Spring Live Broadcast. (1-60).
John Polk, of Hanson Hot Spring, will draw a number from an additional box with 60 tabs, and then announce the winning number. The person who has the winning number wins.

Prize(s): The prizes that will be awarded are: overall value of $7,130 dollars awarded to one (1) winner

1. Solana RX spa from Hanson Hot Spring

2. 1 bedroom condo for 3-nights and 2 lift tickets for 2-days to Crested Butte Lodging

3. $500 gift certificate to Diamond City Jewelers

4. Weekend S.U.V. rental from Budget Rent-A-Car

5. A dozen roses from Skyway Creations

6. Chocolate covered strawberries from Rocky Mountain Chocolate Factory

Eligibility and Limitations.

Participants and winner(s) must be Colorado residents at least 21-years old.
Entries limited to one (1) per person per day. Only one (1) prize awarded per household. Prizes are not transferable, not redeemable for cash or exchangeable for any other prize.
Employees of The Sponsors, the Promotion’s participating sponsors and their advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, whether as “in-laws” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

If winner is unable to meet the above criteria stated in rules 6-9, then he//she will become ineligible to win the “The Big Wet One” and a runner-up will be selected.

Entry Forms. Entries must be handwritten (except on-air or website entries). No photocopies or mechanical reproductions of entry forms are permitted.

Publicity; Privacy. By participating, all participants and winner(s) grant The Sponsors and its promotional partners exclusive permission to use their names, characters, photographs, voices and likenesses in connection with promotion of this and other Promotions and waive any claims to royalty, right or remuneration for such use. By participating in the Promotion, participants agree that The Sponsors may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes.

The winner must pick up or take delivery of the spa no later than April 15 2008// Hanson Hot Spring will deliver the spa within fifty (50) miles of the store at no charge. Store location is Dublin & Academy.

Release. By participating, each participant and winner waives any and all claims of liability against The Sponsors, their employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by The Sponsors.

Rules. Additions or deletions to these rules are subject to the discretion of The Sponsors, and may be enacted without notice at any time during the promotion dates.

Taxes. Any valuation of the prize(s) stated above is based on available information provided to The Sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All federal/state/local taxes are winner’s sole responsibility. Insurance coverage, registration and title transfer fee are also the winner’s sole responsibility. Winners must provide The Sponsors with valid identification and a valid social security number before any prize will be awarded. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

WINNER UNDERSTANDS AND AGREES THAT HE OR SHE IS RESPONSIBLE FOR ALL APPLICABLE TAXES INCURRED ON PRIZES RECEIVED.

Decisions. By participating in the Promotion, participants agree to be bound by the decisions of The Sponsors. The Sponsors reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible, violated any rule or provided false information. If the conduct or outcome of the Promotion is affected by human error, any mechanical or technical errors, malfunctions or failures of any kind, or any event beyond the control of The Sponsors, The Sponsors reserves the right to terminate this Promotion or make such other decisions regarding the outcome as The Sponsors deems appropriate. All decisions will be made by The Sponsors and are final.

Miscellaneous. Each winner must submit proof of eligibility and sign The Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. The Sponsors disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion. Written copies of these rules are available at www.1039theeagle.com, and during normal business hours at The Sponsors locations and by mail upon written request with a stamped, self-addressed return envelope to KYZX The Eagle, 1805 E. Cheyenne Rd. Colorado Springs, Colorado, 80906.

1. 2. I, my heirs, executor, administrator, and assigns, hereby release and forever discharge the Sponsors, their parents, members, subsidiaries, affiliates, any of their officers directors, partners, employees, and advertising, promotional and/or judging agencies, from any and all liabilities, claims, demands, and causes of action of any kind or nature whatsoever in law or equity which I may now or hereafter have against any of them arising out of or in connection with the contest or my participation in the contest or my participation in the contest or the receipt, acceptance, possession, or use/misuse of the prize, including without limitation any court costs, attorney fees, property or personal injury expenses and damages incurred by me in participating in the sweepstakes or in the use/misuse of the prize.
